Brown Fox Trial Team Secures $4.5 Million Jury Verdict in LLC Member Dispute

On October 14, 2022, David Denton and Cort Thomas obtained a unanimous jury verdict of $4.5 million after a week-long trial in the 191st District Court, Dallas County.
Brown Fox’ client, a physician member who had withdrawn from Highland Park Emergency Center, LLC, in 2015, sought to obtain the fair value of his ownership interest in Highland Park. The case involved business valuation issues, and the Brown Fox trial team presented the physician and expert witness testimony to help the jury decide the case. Since the physician’s withdrawal in 2015 and through the date of the jury’s verdict, the remaining members of Highland Park Emergency Center, LLC refused to pay out his ownership interest pursuant the parties’ company agreement.
Following the verdict, Managing Partner Russ Brown spoke of his client and the trial team: “This has been a long road for our client. We are proud to have stood alongside him every step of the way, and last Friday’s jury verdict is a well-deserved victory for him and his family.” Mr. Brown added, “My first day of law school was sitting next to [lead trial attorney] David Denton. We all knew then he would be a dynamic, trustworthy advocate in the courtroom. That’s proven to be the case over the past twenty years. David [Denton] poured himself into our client’s legal battle, allowing our team to put on a clear, consistent, and winning message.”
The Brown Fox trial team was comprised of David Denton, Cort Thomas, paralegal Shannon Latham, with assistance from paralegal Robert Falay and support staff Kimberley O’Rourke and Courtney Trotter.
